Taxian is a platform that brings TaxPayer and ITR filed citizens(India) together to Share things related to Economic, Politic,Education, Finance, Property of Country, World, Economic, Industry, Individuals. Discourse about the most important and exclusive conversation that can or will create a huge positive impact and create a direction for things around you. The Platform for only Design for top wealthiest, top contributors, the individuals has honesty toward country and government. Respect and consider each other and the platform.

These terms set forth our legal obligations to each other. They apply to your use of our products and services.

‍ IMPORTANT NOTE: The section titled “Settling Disputes Between You and Taxian” contains an arbitration clause and class-action waiver that applies to all Indian-based Taxian Members. Please read this section carefully as it may significantly affect your legal rights, including your right to file a lawsuit in court.

When we say “Taxian” “we,” “us,” and “our” in these terms, we mean TFIFC TECHNOLOGIES PVT LTD its companies.

When we say “services” in these terms, we mean Taxian’s services, apps, websites, and other products.

When we say “you” or “your,” we mean you, “Customer” or “User” or “Member”. If you’re accessing our services on behalf of a legal entity (like your employer), you agree that you have the authority to bind that entity to these terms, and “you” and “your” will refer to that entity.

We also have a Privacy Policy, Members Guidelines that apply to your use of our services and are incorporated into these terms. You should read these policies—we’ve worked hard to make them simple and clear, and they contain important information about your use of our services..

Together, these rules make Taxian possible, and they matter to us. If you believe others aren’t following them, please let us know by reporting it to us.



Who we are


We provide services that allow you to interact with other Taxian Members and avail various products and services for members to purchase and get free or privileged services. We are designing a platform for Taxpayer and ITR filed citizens of India. Mean if you paid tax (TDS and filed ITR and you're eligible to use our platform. Our services may also include access to certain features, services and content that you can purchase from us or partner brands, and additional terms apply to those purchases.

Our Vision is to build a platform of utmost authentic and pinpoint services, facilities, privilege, superiority to Taxpayer and Itr filed citizens of India.

Taxian’s services are provided by TFIFC TECHNOLOGIES PVT LTD. We’re located at F01/02, Ground Floor, Salcon Rasvilas, D1, Saket District Centre, Sector 6, New Delhi, Delhi 110017



Age requirements and responsibility


By accessing our services, you confirm that you’re at least 18 years old and meet the minimum age required by the laws in the country. We maintain a list of minimum ages across the country (India) as a resource for you, but we aren’t able to guarantee and guarantee as govt. ID that it is always accurate. If you are old enough to access our services in your country, but not old enough to have authority to consent to our terms, your parent or legal guardian must agree to our terms on your behalf. Please ask your parents or legal guardian to read these terms with you. If you’re a parent or legal guardian, and you allow your child (who meets the minimum age for your country) to use the services, then these terms also apply to you and you’re responsible for your child’s activity on the services, including purchases made by them. Why Is Taxian Asking For My Birthday?


Taxian's Terms of Service require people to be over a minimum age to access our app or website, so we require users to confirm their age to satisfy that minimum age requirement. We use this information in accordance with our Privacy Policy and to keep our users safe and ensure they don't encounter material that's not appropriate for them.
We’ll also use it to better understand how you use Taxian and improve and personalise your user experience.



PAN verification


Taxian aims to cater exclusively to Indian taxpayers and individuals who have filed their Income Tax Return (ITRs), providing a range of facilities and privileges across diverse products and services. In our commitment to establishing an authentic and secure platform, ensuring value delivery through meticulously designed products and services, we prioritise the authentication of tax or TDS, TCS, Dividend and ITR filings to verify eligibility.



The information we get when you enter PAN


Taxian do not retain access to your tax-related information. Through the Income Tax Department's authorised ERI APIs, our system can only authenticate whether 'Y' signifies payment of tax or TDS or Dividend or TCS or filing of an ITR, while 'N' denotes non-payment tax or TDS or Dividend or TCS or filing of an ITR.

Taxian exclusively stores PAN Numbers to facilitate access to our services and platform for specific individuals.

Please note: Taxian is a newly launched application available for all to explore its innovative facilities. Initially, access is open to both non-taxpayers and ITR-filed citizens for a limited period. Non-taxpayers and ITR-filed citizens who purchase services will retain access to Taxian until the service validity ends. However, for those who have not purchased services, access to Taxian will be discontinued in forthcoming updates, specifically for non-taxpayers and ITR-filed citizens.

Taxian will promptly inform you about any upgrades, modifications, or enhancements in PAN verification on a priority basis.



What you can expect from us


Taxian is a platform that brings people together over shared experiences and gives everyone a place to belong. To do that, we provide different digital spaces where you can connect with other Taxian members. Taxian Members communicate primarily via “chat and Text,” which are digital spaces. Text channels allow members to interact via text-based messages or posts, as well as images, GIFs, emoji, and other uploadable media. We’re always evolving our services, and we may create other types of channels in the future!

Taxian offers an array of current and potential products and services available to its members. These offerings are either developed by Taxian or are presented in collaboration with a diverse array of brands and companies. Taxian members have the opportunity to procure these facilities directly through the Taxian platform.

Our platform is committed to consistently expanding its repertoire of offerings to cater to the evolving needs of our members. These services encompass a broad spectrum. Members can seamlessly access and engage with these offerings, benefiting from a convenient and centralised platform for their financial and service needs.

Taxian's dedication to enhancing member experience drives our continuous efforts to introduce new collaborations, features, and services. We strive to ensure that our platform remains dynamic and responsive to the preferences and requirements of our esteemed members."

Taxian’s services may be personalised to each user based on their activity, so that you can see content and communities that may be of interest to you. You can control whether and to what extent Taxian personalised your experience.

We’re actively developing new features and products to improve Taxian. As part of these efforts, we may add or remove features, start offering new services, or stop offering some services entirely (or just in some places or for some users) if they no longer make sense from a business perspective or create risk for Taxian, our members, or other third parties. While we try to avoid disruptions, we cannot guarantee that there will not be an outage or change to the services, and your content may not be retrievable due to such outages or changes. We are not liable for any such outages or service changes.



Your Taxian account To access the services on an ongoing basis, you will need to create a Taxian account. You can provide a username and password, and a way of contacting you (such as an email address and/or phone number/PAN). You may also need to provide your birthday, Profession. In some cases, you may be required to verify your account or provide additional information.

You are responsible for the security of your account, and you agree to notify us immediately if you believe your account has been compromised. If you use a password, it must be strong, and we (strongly) recommend that you use that password only for your Taxian account.

You must always provide accurate information to Taxian. If you use others' PAN ID’s we may block you or your mobile numbers and maintain the accuracy of the information associated with your account. We may assume that any communications we’ve received from your account or the associated contact information have been made by you, and that any purchases made using your account were made by you.

If you get locked out of your account, we’ll need to contact you at the email or phone number associated with your account. If your account is compromised or you no longer have access to your email account or phone number, we may not be able to restore your access to your account.

You agree not to licence, sell, or transfer your account without our prior written approval.



Content in Taxian’s services



Your Content


When we say “your content” in these terms, we mean all the things you add (upload, post, share, etc.) to our services. This includes text, links, GIFs, emoji, photos, videos, documents, or other media. If we come up with another way for you to add content to the services, it includes that too.

You don’t have any obligation to add content to the services. If you choose to add content to the services, you are responsible for ensuring that you have the right to do so, that you have the right to grant the licences in this section of these terms, and that your content is lawful. We take no responsibility for any of your content, and we are not responsible for others’ use of your content.

Your content is yours, but you give us a licence to it when you use Taxian. Your content may be protected by certain intellectual property rights. We don’t own those. But by using our services, you grant us a licence—which is a form of permission—to do the following with your content, in accordance with applicable legal requirements, in connection with operating, developing, and improving our services:
Use, copy, store, distribute, and communicate your content in manners consistent with your use of the services. (For example, we can store and display your content.)
Publish, publicly perform, or publicly display your content if you’ve chosen to make it visible to others.(For example, we can store and display your content.)
Monitor, modify, translate, and reformat your content. (For example, so we can resize an image you post to fit on a mobile device.)
Sublicense your content, to allow our services to work as intended. (For example, we can store your content with our cloud service providers.)

This licence is worldwide, non-exclusive (which means you can still licence your content to others), royalty-free (which means there are no fees for this licence), transferable, and perpetual.

We reserve the right to block, remove, and/or permanently delete your content if it is in breach of these terms, our Community Guidelines or any applicable law or regulation, or if it creates risk for Taxian or negatively impacts the experience or interests of other Taxian Members to continue to make it available.

We welcome feedback on our services. By sending us feedback, you grant us a non-exclusive, perpetual, irrevocable, transferable licence to use the feedback and ideas generated from the feedback without any restrictions, attribution, or compensation to you.



Taxian’s content


Our services include some content that belongs to us, such as the design of our apps and websites, our art and images, and content written by us. You may use this content as permitted by these terms, but we retain all intellectual property rights in our content.



Other content


Other people’s content. Our services might also provide you with access to other people’s content. You may not use this content without that person’s consent, or as allowed by law. Other people’s content is theirs and doesn’t necessarily reflect Discord’s own views. Taxian doesn’t endorse or verify the accuracy or reliability of content shared by Taxian members. We work hard to try to make members a safe, positive, and inclusive place, but cannot prevent you from encountering content that you may find objectionable or offensive. You agree we will not be liable for any harm caused by that content. You may report content that you think violates any of our policies. We have the right, but not the obligation, to review such reports and block or remove content at our discretion.
Third party features and content. Our services may also allow you to access third-party websites, features, apps, or other content. We provide you access only as a convenience to you, and are not responsible for the content or services available from these websites or resources.



Taxian’s paid services


We won’t charge you a fee to use the basic functionality of our services, but you may be able to pay for additional features and products. Any purchase you make using Taxian’s supported purchase flows, and you may also be asked to agree to separate terms before purchasing or listing new offerings, products and services through Taxian.

You are responsible for any charges that may be applicable to certain services or use of the Taxian App; where you will be notified of such applicable charges, prior to the completion of any transaction. By clicking ‘Proceed’ / ‘Submit’ / ‘Continue’ or any other similar button on the Taxian App, You shall be deemed to have consented to the charges displayed on the said page.



Restrictions on your use of Taxian’s services


When using our services, you must comply with these terms and all applicable laws, rules, and regulations, and you must only use the services for authorised and acceptable purposes. You must also adhere to our Members Guidelines and other policies, which contain more detailed rules about your content and behaviour when using Taxian. Fundamentally, do not do, try to do, or encourage or help others to do any of the following:

Don’t use the services to do harm to yourself or others. Among other things, this includes trying to gain access to another user’s account or any non-public portions of the services, infringing anyone else’s intellectual property rights or any other proprietary rights, exploiting, harassing, bullying, spamming, auto-messaging, or auto-dialling people through our services.
Don’t use the services to do harm to Taxian. Among other things, this includes trying to gain access to or attacking our systems, scraping us, transmitting viruses or other malicious code to our services, abusing or defrauding us or our payment systems, copying our product or using our intellectual property without permission, and misusing our reporting or customer service mechanisms.
Don’t use the services to do anything else that’s illegal. This includes using the services to plan or commit any crime or do anything else that is illegal.

We encourage you to report content or conduct that you believe violates these restrictions.



Termination


Your right to terminate. You’re free to stop using Taxian’s services at any time and for any reason. To terminate this agreement, you may delete your Taxian account through the Settings page or tell us to delete at support@taxian.in the Taxian app (the gear icon next to your username) and discontinue use of the services. Certain provisions of these terms will survive termination as outlined below in the “Survival” section. Disabling your account limits the processing of your personal information as described in our Privacy Policy. Disabling your account does not terminate this agreement.

Our right to terminate. Subject to applicable law, we reserve the right to suspend or terminate your account and/or your access to some or all of our services with or without notice, at our discretion for the following reasons:

You breach these terms, our policies, or additional terms that apply to specific products.
We’re required to do so to comply with a legal requirement or court order.
We reasonably believe termination is necessary to prevent harm to you, us, other users, or third parties.
Your account has been inactive for more than three years.
Continuing to allow your account to be active, giving you access to some or all services, or hosting your content creates risk for Taxian, other users, or third parties.

However, we will give you advance notice if reasonable to do so or required by applicable law.



Limitation of Liability


In no event shall Taxian, their officers, shareholders, subsidiaries, associate companies, directors, employees and agents, partners, co-branders, licensors, licensees, consultants, or contractors be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages or losses whatsoever, or damages for loss of data or profits, goodwill, and/ or other intangible loss, whether or not foreseeable and regardless of whether Taxian has been advised of the possibility of such damages, or based on any theory of liability, including breach of contract or warranty, negligence or other tortious action, or any other claim arising out of or in connection with your use of, or access to, the Taxian Platforms, Taxian App or Taxian Services.

In no event shall Taxian total cumulative liability to You in connection with the Taxian Services for all damages, losses and causes of action (whether arising under contract or otherwise), arising from or relating to Your use of the Taxian App and Taxian Platforms or arising from these Terms of Use exceed INR 10,000 (Indian Rupees ten thousand only).



Indemnity


You agree to defend, indemnify and hold harmless Taxian, its officers, owners, directors, employees and agents, partners, co-branders, licensors, licensees, consultants, contractors and other applicable third parties (collectively ‘Indemnified Parties’) from and against any and all claims, demands, damages, obligations, losses, liabilities, cause of action, costs or debt, and expenses (including any legal fees) arising from:

a. your use of and access to the Taxian App and the Taxian Platforms;
b. your violation / breach of any of these Terms of Use;
c. your violation of any third party right, including any intellectual property right or privacy right;
d. the committing of any of the prohibited activities as stated herein;
e. your failure to be in compliance with applicable law, including tax laws and cyber security laws; or
f. any claim that your use of the Taxian App caused damage to a third party.



Disputes & Arbitration


In consideration for Taxian granting you access to and use of the Taxian App, Taxian Platforms and Taxian Services, you agree that in case of any dispute between You and any Commercial Partner or other User or recipient of the funds transferred by You, Taxian shall not be a party to the same. While Taxian is not obligated to mediate or resolve disputes, Taxian will assist Users in communicating with each other regarding a dispute. Taxian may at its own discretion however, without having any obligation to do so, assist in resolving the disputes between the Users and the Commercial Partners.

Except as otherwise set forth in these Terms of Use, these Terms of Use shall be exclusively governed by and construed in accordance with the laws of India. Any dispute, conflict, claim or controversy arising out of or broadly in connection with or relating to the Taxian Services or these Terms, including those relating to its validity, its construction or its enforceability, but excluding those provisions where it has been specified that Taxian’s decision shall be final, (any “Dispute”) shall be, if initiated by the User, first raised by the user to grievance.officer@taxian.in. If such Dispute has not been settled within sixty (60) days after the User reaches out to the aforementioned email IDs, such Dispute can be referred to and shall be exclusively and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996 (“Act”). Provided however when Taxian raises any dispute, Taxian may directly initiate arbitration in accordance with this clause. The Dispute shall be resolved by one (1) arbitrator to be appointed by Taxian. The place the arbitration shall be Delhi, India. The language of the arbitration shall be English. The existence and content of the arbitration proceedings, including documents and briefs submitted by the parties, and correspondence, orders and awards issued by the sole arbitrator, shall remain strictly confidential and shall not be disclosed to any third party without the express written consent from the other party unless: (i) the disclosure to the third party is reasonably required in the context of conducting arbitration proceedings; and (ii) the third party agrees unconditionally in writing to be bound by the confidentiality obligation stipulated herein.



Use and Protection of Intellectual Property Rights


Taxian Apps, Taxian Website, Taxian logos and the Taxian Services are protected by copyright, trademarks, patents, trade secrets and/or other intellectual property laws. No information, content or material from the Taxian App including, without limitation, all of the page headers, images, illustrations, graphics, audio clips, video clips or text, reports generated, trademarks, trade names may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way without Our express written permission. You are hereby given a limited licence to use the Taxian App and the Taxian Platforms, subject to your agreement of these Terms of Use.

Taxian, and its licensors, if any, are the sole owners of the underlying software and source code associated with the Taxian App and Taxian Platforms as well as any other intellectual property rights of any other nature associated with the Taxian App, Taxian Platforms and their content.

When you upload, submit, store, send or receive content that may include feedback to or through the Taxian App, you give Taxian a worldwide, perpetual licence to use, host, store, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display and distribute such content. This licence shall not expire even if it is not used by Taxian. The rights you grant in this licence are for the limited purpose of operating, promoting, and improving the Taxian Services, and to develop new ones. This licence continues even if you stop using the Taxian Services.



Governing Law and Jurisdiction


The Taxian App, the Taxian Services, all your posting, listing & transactions with the Taxian App, and our relationship shall be governed by the laws of India, without regard to conflict of law principles. You agree that subject to the Disputes & Arbitration Clause above, all claims, differences and disputes which we may have shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India.



General


No joint venture, partnership, employment or agency relationship exists between you, Taxian or any Third Party as a result of the contract contained in these Terms of Use. If any provision of these Terms of Use is held to be illegal, invalid or unenforceable, in whole or in part, under any law, such provision or part thereof shall to that extent be deemed not to form part of these Terms of Use but the legality, validity and enforceability of the other provisions in these Terms of Use shall not be affected. In that event, Taxian shall replace the illegal, invalid or unenforceable provision or part thereof with a provision or part thereof that is legal, valid and enforceable and that has, to the greatest extent possible, a similar effect as the illegal, invalid or unenforceable provision or part thereof, given the contents and purpose of these Terms of Use. These Terms of Use (together with any additional terms displayed in specific sections of the Taxian App or Taxian Website) constitute the entire agreement and understanding of the parties with respect to its subject matter and replaces and supersedes all prior or contemporaneous agreements or undertakings regarding such subject matter.



Updation


We may amend these Terms of Use at any time by posting an updated version on the Taxian Website. The updated version of these Terms of Use shall supersede the previous version of the Terms of Use and take effect immediately upon posting. You have the right to opt-out of agreeing to these Terms of Use or any future updated version of the Terms of Use, by ceasing to use the Taxian App. However, please be aware that your continued use of the Taxian Services from the launch of any updated Terms of Use would mean deemed acceptance of such updated Terms of Use including any modification thereof. We recommend you to keep checking the Terms of Use often to be familiar with any updates and changes. user to grievance.officer@taxian.in. Terms for Taxian Marketplace


The following terms and conditions (“Taxian Store T&Cs”) are specific to accessing / using the e-commerce marketplace on the Taxian App, where various products, services, experiences may be listed for purchase (“Taxian marketplace”). All Users accessing Taxian marketplace shall be deemed to have read, understood and agreed to be bound by these Taxian marketplace T&Cs.



Nature of Taxian marketplace


Taxian marketplace is a curated e-commerce/booking/subscription platform whereby Taxian marketplace acts as a marketplace for third party sellers (Sellers) to list their products and offer attractive products or services to the Users. For the avoidance of doubt, it is clarified that Taxian marketplace does not maintain any inventory or control over inventory of the products listed on the Taxian marketplace and only provides a marketplace platform (including payment and settlement solution to the Sellers listing the products or services).



Use of marketplace


a. For purchasing products or services on the Taxian marketplace, the User may either (i) pay the full price as listed on the Taxian marketplace for such product; or (ii) avail a lower price as listed on Taxian marketplace. b.For the avoidance of doubt, it is hereby clarified that:
(i) Taxian shall not be liable for any defects in the goods / services sold by the Sellers and does not provide any warranty for any products. Warranty, if any, shall be provided by the Seller. Taxian recommends that each User verify the applicability of warranty terms in respect of each product before purchasing the same through Taxian marketplace.
(ii) Taxian shall not be liable for any claims arising in relation to the delivery of the products or the quality of the goods / services purchased by the User.
(iii) the return, replacement and/ refund in relation to such products/services shall be dealt with in the manner as provided in Taxian’s policies, as available on Taxian Website / other Taxian Platforms; and
(iv) delivery of the products is the sole responsibility of the respective Seller. The delivery service may not be available for all pin codes and the User must verify if the delivery service is available at the pin code provided by the User prior to placing an order.



Pricing & Availability


a. We list availability information for products and services sold by us on the App, including on each product information page. Beyond what we say on that page or otherwise on the website, we cannot be more specific about availability. Please note that dispatch estimates are just estimates. They are not guaranteed dispatch times and should not be relied upon as such. As we process your order, you will be informed by email if any products you order turn out to be unavailable.
b. All prices are listed in Rupees. Items in your cart will always reflect the most recent price displayed on the item's product detail page. Please note that this price may differ from the price shown for the item when you first placed it in your cart. Placing an item in your cart does not reserve the price shown at that time. It is also possible that an item's price may decrease between the time you place it in your cart and the time you purchase it.
c. All prices displayed are inclusive of Goods and Services Tax ("GST"), duties and cesses as applicable - unless stated otherwise.



Offers


Taxian may from time to time make available either directly or in partnership with Sellers certain benefits for using the Taxian marketplace. All such offers shall be governed by their terms and conditions displayed on the Taxian App in addition to these Taxian marketplace T&Cs. Taxian’s decision of the winner of such offers shall be final and binding and not subject to any appeal or dispute resolution process.



Cancellation, Returns and Refunds


Orders for goods and services once placed cannot be cancelled. Orders for travel packages are subject to relevant cancellation policy for each package. Taxian general return and refund policy is as set out – here. Certain products may have differing return / refund terms as set out in the Taxian App.



Grievance Redressal / Nodal Officer


Should You have any issues or queries in relation to Taxian marketplace, You may reach out to the Taxian’s customer support team using the chat function on the Taxian App. In the event that You are not entirely satisfied with the response, You may raise your grievance to the grievance redressal officer.

Taxian has appointed a grievance redressal to address any grievances in respect of the Taxian marketplace. Details of the said officer are as set out below:

Following the procedure adopted for redressal of grievances, Grievance Redressal officer shall acknowledge all grievances within 48 (forty-eight) hours of receipt and shall address them within a period of 1 (one) month. The Grievance Redressal Officer as set out above, also acts as the nodal officer to ensure compliance with various applicable laws and regulations including the Consumer Protection (E-Commerce) Rules, 2020.
